<p>Судья вынес решение о привлечении в качестве ответчика отца Ефимова как правопреемника исходя из того, что согласно ст. 94 СК дедушки и бабушки обязаны содержать своих несовершеннолетних внуков в случае невозможности получения ими содержания от родителей.</p>
<p>Правильно ли определение судьи?</p>

<p>Отцовство Ефимова должно быть в соответствии со ст. 247 ГПК РФ установлено в порядке особого производства, лишь после этого должен быть подан иск в соответствии со ст. 94 СК РФ. Однако надо помнить, что в соответствии с ч. 3 ст. 98 СК РФ, если содержать члена семьи, требующего алименты, обязаны одновременно несколько лиц, суд в зависимости от их материального и семейного положения определяет размер участия каждого из них в выполнении алиментной обязанности.</p>
<p>При определении размера алиментов суд вправе учесть всех лиц, обязанных уплачивать алименты, независимо от того, предъявлен иск ко всем этим лицам, к одному из них или к нескольким из них.</p>
<p>Следовательно, в данном случае, с одинаковыми основаниями можно обратиться с подобным иском и к бабушке и дедушке по линии матери на взыскание алиментов.</p>
<p>На мой взгляд, на решение судьи в соответствии с ч.3 ст. 44 ГПК должна быть принесена частная жалоба.</p><h2>Вопрос</h2>
